After 3rd DWI, man to get prison

A Stormville man who was caught driving drunk for the third time in less than three years faces a prison term for the crime when he returns to court on Feb. 24.

Luis Gonzalez, 31, of Sunny Lane, entered a guilty plea Tuesday in Dutchess County Court to a felony charge of driving while intoxicated.

He acknowledged he had been drinking beer on the night of Aug. 18, 2008, before police stopped his car in East Fishkill.

According to court documents, Gonzalez had a blood-alcohol level of 0.18 percent - more than twice the legal limit - when he was arrested.
Stricter felony charge

The charge was a Class D felony because Gonzalez was convicted of a misdemeanor charge of DWI in Beacon in May 2006 and a Class E felony charge of DWI in Dutchess County Court Sept. 20, 2006.

In exchange for his plea Tuesday, Gonzalez was promised a sentence of no more than one to three years in state prison.

He remains jailed pending his sentencing.
