Judges uphold DUI conviction, prison sentence

A Pine Grove Township man will go to prison after a three-judge state Superior Court panel upheld his conviction for driving under the influence in February 2011 on Interstate 81.

In a 10-page opinion filed Monday in Pottsville, the panel ruled the evidence was sufficient to establish the guilt of Jerry W. Lucas Jr., 54, of Suedberg.

As a result, Lucas will spend one to five years in prison, the sentence county Judge John E. Domalakes imposed on him on May 21, 2012. Domalakes, who also sentenced Lucas to pay costs, a $2,500 fine and $300 to the Substance Abuse Education Fund, but allowed him to remain free during his appeal, has ordered the defendant to report to prison April 29.

In a one-day trial over which Domalakes presided, a jury found Lucas guilty on April 17, 2012, of DUI. Domalakes found him not guilty of disregarding traffic lane, failure to drive at a safe speed and failing to stop and give information or render aid.
