11 drivers charged with DWI

Police nabbed at least 11 motorists on drunk driving charges following Sunday's Bills game in Orchard Park.State Police reported 10 arrests for driving while intoxicated across Erie and Niagara counties.
The Erie County Sheriff's Office also arrested a Rochester man on felony DWI charges.
Allen D. Ruiz, 25, failed a series of roadside sobriety tests after he was pulled over, the sheriff's office said.
Ruiz, whose driver's license has been suspended five times, refused to take a Breathalyzer test, according to a report. He also has a DWI conviction from August 2004, the sheriff's office said.
He was taken to the Erie County Holding Center and will be arraigned in Orchard Park Town Court.

Drunk driving simulator set for stop at Tinker

The Air Force is always encouraging its members to be better wingmen. The Tinker Alcohol Drug Abuse Prevention and Treatment Office will be hosting the “Save-A-Life” Tour interactive drunk driving simulator, from 8 a.m. to 4 p.m. Oct. 1 at Bldg. 230 Dock 2.

“The ‘Save-A-Life’ Tour is visiting 35 Air Force bases across the country. The tour goal is to help change in attitude and behavior through awareness, while deglamorizing alcohol use in the areas of DUI/DWI, underage drinking, and alcohol-related fatalities,” said Mildred Fitch, licensed alcohol and drug abuse counselor.

Military, civilian and dependents of the Tinker community will have the opportunity to learn ways to save a life with something as simple as a right decision.Read More

Town of Pamelia Man Charged with Driving While Drunk

The following motorists are charged with driving while intoxicated and related offenses:

Matthew L. Mehaffy, 26, of 23735 Patterson Road, Watertown, was charged by Jefferson County sheriff's deputies at 10:30 p.m. Sept. 13 on County Route 138 in the town of LeRay with DWI and first-degree aggravated unlicensed operation of a motor vehicle. His blood alcohol content was 0.14 percent, deputies said. A BAC level of 0.08 percent or more is considered proof of intoxication under state law. He was additionally cited with speeding 50 mph in a 35-mph zone, they said. He is to answer the charges in LeRay Town Court.Read More

Retired trooper could face charges in fatal DWI The retired state trooper accused of killing someone when he drove drunk could face more serious charges. Frank Murray's case is going to a grand jury next month to determine if he could face felony charges. Right now he's only charged with a misdemeanor DWI.Police say Murray was driving drunk when he hit and killed Harry Thorton last month. His license has been suspended.

Driving While Intoxicated Reasonable Suspicion to stop

DWI Reasonable Suspicion to stop

There are several situations in which the officer will come into contact with a driver, some examples are:

  • The driver has been involved in an automobile accident; the officer has responded to the scene and is conducting an investigation.
  • The driver has been stopped at a sobriety checkpoint (also known as roadblocks).
  • The police have received a report, possibly from an anonymous citizen, that a described car has been driving erratically. The officer should verify the erratic driving before pulling the driver over. In some cases, the driver will no longer be in the vehicle.
  • The officer on patrol has observed erratic, suspicious driving, or a series of traffic infractions indicating the possibility that the driver may be impaired. This is by far the most common reason for stopping a suspect.
  • A police officer has stopped a vehicle for a lesser traffic offense, notices the signs of intoxication, and begins the DUI investigation.

The following list of DUI symptoms, from a publication issued by the National Highway Traffic Safety Administration (DOT HS-805-711),[5] is widely used in training officers to detect drunk drivers. After each symptom is a percentage figure which, according to NHTSA, indicates the statistical chances through research, that a driver is over the legal limit.

If it is determined after arrest that the person's blood alcohol concentration is not at or above the legal limit of .08, they will probably be released without any charges. One may, however, still be charged with driving under the influence of alcohol on the basis of driving symptoms, observed impairment, admissions and/or performance on the field sobriety tests. And if there is suspicion of drug usage, a blood or urine test is likely, or at least the testimony of a specially-trained officer called a Drug Recognition Expert (DRE). Assuming sufficient evidence of impaired driving from drugs, the arrestee may face charges of driving under the influence of drugs or the combined influence of alcohol and drugs.
